These Additional Terms, which form an integral part of the Agreement and supplement the General Terms of Service, set forth the terms and conditions applicable to certain Services. Capitalized terms used but not otherwise defined herein shall have the meanings ascribed to them in the Agreement. Signitic reserves the right to amend these Additional Terms at any time, in accordance with the procedures set forth in the Agreement.
Signitic may also make available features based on the use of Artificial Intelligence, specifically for the purpose of assisting with drafting or generating banners and associated content, as well as analyzing their performance, under the conditions set forth below.
This Section applies to the use by Signitic of artificial intelligence systems (hereinafter “AI”), both for its own operational needs—specifically to provide or improve the Services—and for features integrating or relying on AI processing made available to the Customer as part of the Services, including assistance with the creation of signatures, banners, and marketing campaigns, performance analysis, and the detection of anomalies within elements configured by the Customer.
Certain AI services offered by Signitic may rely on technologies or APIs provided by third-party service providers (hereinafter “Third-Party Providers”). In this context, the Customer is informed that any element or data, including Personal Data, that it inputs, submits, or generates through these features may be transmitted to Third-Party Providers for the purpose of providing said features.
Accordingly, when Signitic provides or integrates an AI system into the Services, including a general-purpose AI system, it undertakes to make available, or provide upon the Customer’s request, a description of said system and to indicate its risk level, in accordance with the classification set forth under the AI Act regulation.
The Customer agrees to use the AI features made available to it in accordance with the Agreement, the Acceptable Use Policy, and, where applicable, the terms of use of the relevant Third-Party Provider, as well as in compliance with applicable law and third-party rights, particularly regarding intellectual property and confidentiality.
Accordingly, the Customer remains solely responsible for (i) any element or data it submits to the AI, and (ii) any element, output, or data it generates via the AI, including verifying the relevance, reliability, and legality of the produced results prior to any use, dissemination, or decision based thereon. The Customer acknowledges that AI constitutes an assistive tool and not an autonomous decision-making mechanism.
Signitic does not warrant that the outputs produced by the AI will be error-free or unbiased, nor that they will meet any specific purpose of the Customer or produce expected results. Signitic shall not be held liable in the event of total or partial unavailability of the AI features, particularly where such unavailability results from a failure of the relevant Third-Party Provider, a temporary interruption for maintenance, or a geographic, regulatory, or technical access restriction imposed by the Third-Party Provider or a competent authority. Furthermore, Signitic shall not be held liable for any breach by the Customer of its obligations under the AI Act Regulation and any applicable law or regulation relating to the use of AI tools.
